Official Rules and Terms and Conditions

In consideration for the opportunity to have your card design considered by Hallmark Cards, Incorporated ("Hallmark") in the "YourFunny*Ness" contest (the "Contest"), and by submitting your card design entry ("Entry"), you agree to the following:

How to enter. All entries must be submitted online to: hallmark.com/you. Entries must consist of artwork or a photo in a high quality .pdf or .jpg format. Submissions must be 300 dpi or higher or 1,200 x 1,800 pixels; actual measurements should be around a 4" x 6" vertical format. Entries must be in English. Hallmark reserves the right to adjust or modify the copy and adjust, modify and crop the image. You must fill out the Official Contest Entry Form completing steps one through five. You can include one design (images and/or text) on the front of the card and copy (text) only on the inside of the card. Official Entry Forms along with your image and copy must be completely filled out to be eligible for judging. Entries without an agreement to the terms and conditions on the Official Entry Form will be disqualified without notice. Entries for the Contest must be received by Hallmark via the official contest website between 12:01 a.m. CST on March 3, 2008, and 11:59 p.m. CST on March 23, 2008 ("Contest Period"). You may enter the Contest only once. Hallmark is not responsible for lost, stolen, illegible, misdirected or late submissions. Hallmark assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kind, delayed computer transmissions or network connection problems that are human or technical in nature.

Eligibility. The Contest is open to all legal residents of the fifty (50) United States and Canada, excluding Quebec, age 15 or older as of start of Contest Period, but not including employees of Hallmark and its subsidiaries and affiliates, their respective advertising and marketing agencies associated with this Contest and their subsidiaries, affiliates, divisions and related companies and all children, spouses, siblings and parents of those employees, and employees of American Greetings or Recycled Paper Greetings. All Entrants must have a valid email address. In the event of a dispute as to who has entered from a particular email address the registered owner of that email address shall be deemed to be the entrant. Entrants who are minors in their state of residence must have their parent's permission. Proof of parental consent will be required prior to a minor being named as an official Finalist.

Judging. A panel of expert judges, appointed by Hallmark, will select 18 Finalists. Entries will be judged on the following criteria: Marketability, taking into account such factors as originality, humor and appeal to a wide audience. At the judges' discretion, entries including unsuitable content, insufficient photo resolution, sexually explicit or inappropriate content, descriptions or images of animals or people in unsafe conditions, or content that is in violation of third party rights (including, but not limited to, copyrights) will be immediately disqualified. Hallmark retains sole discretion as to what constitutes unsuitable content and will not be liable in any way for disqualified entries. Entrants will not be notified if their entry is disqualified. All entrants agree that judges' decisions are final, binding and are not open to challenge.

The Finalists' Entries will be posted on Hallmark.com/you on or about April 14, 2008. (Potential Finalists will be notified by FedEx during the period March 28 — April 14, 2008, and must provide requested items within three (3) days as specified below in order to be named an official Finalist). Hallmark is not responsible for any change of email address, postal address, or phone number or for any failure of a potential finalist to receive notification. Hallmark will allow visitors to Hallmark.com/you to place one vote per day for their favorite Finalist design, based on the following criteria: Funniest, taking into account such factors as originality, humor and appeal to a wide audience, during a period from 12:01 a.m. CST on April 14, 2008, to 11:59 p.m. CDT on August 31, 2008 ("National Voting Period"). The Grand Prize Winner will be determined by the Finalist card design that receives the largest number of votes during the National Voting Period. In the case of a tie, the tying entries will be rejudged by a panel of judges selected by Hallmark. Each of the Finalist designs will be offered for sale to the public on Hallmark.com and at participating retailers from approximately June 16, 2008 through August 31, 2008 (actual dates to be determined at the sole discretion of Hallmark and Hallmark retailers). Grand Prize winner will be announced on or about September 1, 2008.

Prizes. 18 Finalists: (1) Card design will be printed and available for sale on Hallmark.com and at participating U.S. retailers from approximately June, 16, 2008 through August 31, 2008; (2) $250 cash award; and (3) remain eligible for the Grand Prize and Mini-Contests.

Alternates: Alternates will be contacted, at Sponsor's discretion, in case any of the 18 Finalists are disqualified for any reason. An alternate will not be considered a Finalist until further notified.

Grand Prize Winner: (1) Card design will be available for sale on Hallmark.com for at least a year with the possibility of being offered for sale at retail in the U.S. as well, (2) $100 worth of Shoebox cards, (3) A $1,000 cash award, and (4) a Weekend with Chicago's Second City for you and a friend. Trip includes round-trip, coach class air transportation for two (2) from the airport nearest winner's home within Canada and the continental U.S. to Chicago; one (1) double occupancy standard hotel room for two (2) nights/two (2) days, $600 spending money to be used toward meals, two (2) tickets to the Mainstage and e.t.c. Second City shows on a weekend night, the opportunity to go backstage and meet the Second City Cast, pending availability, a private one (1) hour Improv Workshop, and a walking tour of Chicago with a Second City actor.. Approximate retail value of Weekend with Chicago's Second City ("ARV") up to $3,150, depending upon winner's point of travel origin and airfare fluctuations at the time of taking the trip. Selection of airline, hotel, are solely within Hallmark's discretion. All other expenses not specifically mentioned herein are solely the winner's responsibility. All travel must be taken on dates specified; no alternative travel dates are available or prize will be forfeited and may be awarded to an alternate. All travel subject to availability and restrictions. Winner and travel guest must travel on same itinerary. If winner is a minor in his/her state of residence, the travel guest must be winner's parent or legal guardian. A minor may accompany winner as a travel guest only if the winner is the minor's parent or legal guardian. Minors must be accompanied at all times during trip (including, but not limited to, in-flight, hotel stay and all prize-related events) by minor's parent or legal guardian. Travel guests must sign and return a travel release before any ticketing of travel occurs. Winner and guest must have all necessary identification and/or travel documents (e.g., a valid U.S. driver's license) required for travel. Travel must be completed by June 30, 2009. Prize is forfeited if Winner cannot travel by this date. Exact travel dates and accommodations subject to availability. If the Grand Prize winner is a minor they must be accompanied by a parent or legal guardian. Tips, gratuities and any other expenses not listed herein are the responsibility of Winner. Any difference between stated approximate value and actual value of Contest Prize will not be awarded. ARV of all prizes $4,250[].

Mini-Contests. From time to time during the Contest Period, Sponsor may announce "special" or "category" voting contests for ALL entries for prizes to be announced at those times. Entrants agree that their Entries may be posted on the site, even if not selected as a Finalist. These Official Rules shall apply as to all matters except as specifically announced otherwise for a Mini-Contest promotion, such as regarding specially announced judging criteria, voting deadlines, etc. Sponsor reserves the right to post special rules pertinent to such Mini-Contests, if any. By entering this Contest, Entrants agree that their Entries may be highlighted or included in such Mini-Contests at Sponsor's discretion. Check the website from time to time to participate in these Mini-Contests.

Winners are responsible for all applicable taxes. Prizes are non transferable and may not be redeemed for cash, except in Sponsor's discretion. Hallmark reserves the right to substitute the entire prize or any portion of it for a prize of equal or greater value.

Warranties and Permissions. You grant, or warrant, that you are the creator and copyright owner of all content (graphics, illustrations, pictures and text) used in your design (the "Content") or that you have acquired all rights necessary (including without limitation any permissions for individuals featured in Entry photographs) and will produce these documents upon request to allow Hallmark to use the Content as described here and in the Contest, and that you grant to Hallmark a royalty-free, perpetual, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Rights that may exist in such Content. You also warrant and represent that the Content has not been previously published nor has it won previous awards and that you have obtained the written consent of any identifiable persons in the Content to use their likenesses in connection with this Contest and will provide such permission and accompanying documentation at Sponsor's request. Minor finalists must have the consent of their parent or legal guardian, who must sign all documents and return as indicated above.

You understand and acknowledge that Hallmark is in the business of designing and manufacturing greeting cards and therefore does not agree to treat your entry as secret or confidential. We hope you will understand that the intent of this policy is to avoid misunderstandings when projects developed by Hallmark's very productive staff are similar to someone else's creative work (and possibly yours). Accordingly, as a condition of entering, you release Hallmark from any and all claims, liability or causes of action arising from or related to the Content, and you will not be entitled to any compensation from Hallmark with respect to your entry or the Content other than as provided to winners of the Contest. You also release Hallmark, the Contest judges, The Second City, Hallmark's advertising and marketing agencies and the officers, employees, consultants and advisors of both of them ("the Release Parties") from any and all claims of any nature arising from this contest, your entry, the Content and the use of the Content in any manner by any person. You acknowledge that, by acceptance of your submission, Sponsor does not waive any rights to use similar or related ideas previously known to or later developed by Sponsor.

Entries become the property of Sponsor and none will be returned. You give full consent to Hallmark (and parties deriving rights from Hallmark) to use the Content and your name, your likeness, home city and state (except where prohibited) in products and in all forms of advertising, promotional, editorial, marketing and collateral materials, specifically including but not limited to displaying your entry on Hallmark's Web site, Web sites operated by Hallmark marketing partners or any other third party, without additional compensation or permission, except where prohibited by law. You warrant that you have all necessary rights and permissions in the Content to allow Hallmark (and those deriving rights from Hallmark) to exercise the rights granted herein without infringing upon the rights of third parties.

To be officially named as a Finalist, you will be required to provide proper identification, identification of the origin of elements of the Content, documents confirming your ownership of any rights and permissions necessary for Hallmark to exercise the rights granted herein, an affidavit of eligibility, a promotional release, and release from liability in favor of the Release Parties within three (3) days (72 hours) after receiving FedEx notification from Hallmark.. In the event you do not supply the requested items within the time specified, you will not be an official Finalist and your entry will be disqualified without further notice. Hallmark's decisions as to eligibility are final and not open to challenge.

Hallmark reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or only the Internet portion, and to randomly award the prizes from among all eligible Entries received prior to action taken by Sponsor, should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Hallmark's control corrupt the administration, security, fairness, integrity or proper administration of the Contest. In the event that Hallmark does not receive at least 18 qualified and eligible entries on or before the end of the Contest Period, Hallmark reserves the right to extend the entry deadline by up to 7 days, by notice given on this website. In the event of such an extension, judges will not discriminate between those entering prior to and after the original deadline, but Hallmark will not be required to produce any given card, regardless of ultimate finalist status. Void where prohibited or restricted by law. Subject to all federal, state and local laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of you, Hallmark and the Released Parties, shall be governed by and construed in accordance with the laws of Missouri without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of Missouri.

General. ENTRIES ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT NECESSARILY REFLECT THE VIEWS OF SPONSOR.. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants.
